1. Proclaim June 17 – 24 as Lawrence Juneteenth Celebration.
B. CONSENT AGENDA:
NOTE: All matters listed below on the Consent Agenda are considered under one motion and will be enacted by one motion. There will be no separate discussion on those items. If discussion is desired, that item will be removed from the Consent Agenda and will be considered separately.
1. Approve City Commission meeting minutes from 06/06/06.
2. Receive minutes from various boards and commissions:
Aviation Advisory Board meetings of 04/13/06 and 05/18/06
Public Health Board meeting of 04/17/06
Board of Electrical Examiners & Appeals meeting of 05/03/06
3. Approve all claims. The list of approved claims will be posted to the agenda the day after the City Commission meeting.
4. Approve licenses as recommended by the Department of Administrative Services.
5. Bid and purchase items:
a) Authorize the City Manager to execute a Service Order with Marsh McBirney for installation and initiation of data delivery services for the Permanent Flow monitoring system totaling $282,000. Staff Memo
b) Authorize the City Manager to execute the Wakarusa WRF Supplement #2 for pre-design services with Black & Veatch Engineers increasing the existing services contract for $1,332,000. Staff Memo
c) Approve purchase of Firehouse Software off the state contract from ACS for $45,145. Staff Memo
d) Authorize the City Manager to enter into a contract with Professional Engineering Consultants, from the design/build team of CAS Construction/Professional Engineering Consultants, for $290,800 for preliminary field investigative services to be delivered as part of the design/build services for the construction of the Baldwin Creek 1 Pump Station 1 (BC1PS1). e) Set bid date for Project #1SS-104, North Lawrence Pump Stations 1, 2, and 3 for July 25, 2006. Staff Memo
6. Adopt the following ordinance(s) on first reading:
a) Ordinance No. 7880, adopting the codification of ordinances of the City of Lawrence, Kansas as authorized by Ordinance 7879.
b) Ordinance No. 8013, TA-03-02A-06: A table of clarifying text/corrections is provided to clean up the November 11, 2005 Edition prior to the July 1, 2006 effective date. The majority of the table of recommended revisions is the result of staff and legal counsel review of additional public comment and staff review since the draft was posted on November 11, 2005. c) Ordinance No. 8014, TA-03-02B-06: Section 20-205. Proposed revisions to the purpose statement for the new RMG, Multiple-dwelling Residential-Greek Housing District and to clarify that conversion of Greek Housing to other uses deemed to be compatible with adjacent residential development are permitted through a special use permit for Adaptive Reuse. Conversion to other multiple family residential uses will require rezoning to another RM District. Sections 20-1703 & 20-1704 have been modified to clarify Adaptive Reuse sections. d) Ordinance No. 8015, TA-03-02C-06: Section 20-403 currently permits the development of Retail Establishments, Large in the CS, Commercial Strip District. Public comment has indicated concerns regarding the potential redevelopment of CS properties with big box stores as a permitted use in this district. Authorized by the City Commission on 05/16/06.
e) Ordinance No. 8016, TA-03-02E-06: Proposed revisions to Article 7, Planned Developments. Authorized by the City Commission on 05/16/06. PC Minutes
f) Ordinance No. 8017, TA-03-02F-06: Proposed revisions to 20-908 regarding driveway standards in various residential districts. Authorized by the City Commission on 05/16/06. PC Minutes
g) Ordinance No. 8018, TA-03-02H-06: Proposed revisions to 20-1304 regarding the criteria for Major Changes to Final Development Plans. Authorized by the City Commission on 05/16/06. PC Minutes
h) Ordinance No. 8019, TA-03-02I-06: Amendments to 20-1739 to identify additional uses permitted in the Manufacturing & Production, Limited category to address public comment received at the February 22nd meeting. Authorized by the City Commission on 05/16/06. PC Minutes
7. Adopt the following ordinance(s) on second and final reading:
a) Ordinance No. 7949, TA-07-04-05: Text Amendment to Chapter 21 of the City Code which would eliminate government takings for street or other public purposes as a cause of any setback or required off-street parking violation. (PC Item No. 12; PC approved 8-1 on 9/26/05)
b) Ordinance No. 8004, TA-01-01-06: repeal of the 50' setback along W. 6th Street/US 40 between Monterey Way & Wakarusa Drive (Chapter 21, Article 12). Initiated by the City Commission on January 17, 2006.
c) Ordinance No. 7990, regarding overweight vehicles.
d) Ordinance No. 7991, regarding vehicle safety requirements.
8. Authorize City Manager to execute a Confidentiality Agreement and Entry Agreement with the FI Remediation Trust. These agreements will allow the City and Douglas County to access the former Farmland plant site and review certain documents in the evaluation of the property.
9. Approve as signs of community interest a request from the Downtown Lawrence, Inc. to place banners on the construction fencing in 700 and 800 blocks of Massachusetts.
10. Authorize the City Manager to enter into an Encroachment Agreement with USD 497 for the installation of an ADA accessible ramp in a portion of the right-of-way, adjacent to New York Elementary School, 936 New York Street. Staff Memo & Attachments

2. Conduct public hearing on the creation of a special assessment benefit district for the improvement of Stoneridge Drive south of West 6th Street.

1. Commissioner Schauner will be absent from the June 20 City Commission meeting and Commissioner Hack will be participating via telephone.
REMINDERS:
§ City offices will be closed on Tuesday, July 4, 2006 in observance of Independence Day.
§ The July 11 City Commission meeting will likely begin at 5:00 p.m., depending upon the number of agenda items.
§ There is a City Commission Study Session scheduled for Thursday, July 13 at 9:00 a.m., City Commission Room, First Floor, City Hall. Topic: 2007 City Manager’s Recommended Budget.

Board of Electrical Examiners & Appeals:
One (1) vacancy for the un-expired position held by Dan Wilkus, which expires 03/31/08.
Citizen Advisory Board:
One (1) vacancy for the un-expired position held by Milton Scott, which expires 03/01/08.
Convention & Visitors Bureau Advisory Board:
One vacancy for the un-expired position held by Stephen Horton, which will expire 07/01/07. This position is required to be held by someone in the hotel industry. The following positions will become vacant on 07/01/07: Ron Desch (Hotel Representative), Derek Felch (Hotel Representative), David Longhurst, David Johnston, Doug Holiday, and Bob Schumm. All are eligible for reappointment.
Douglas County Advocacy Council for Aging:
One (1) vacancy for the un-expired position held by Frank Day that will expire 12/31/08, and one (1) vacancy for the un-expired position held by John Studdard that will expire 12/31/07.
Douglas County Emergency Management Board:
One (1) position, held by Truman Waugh, will expire 07/01/06. Mr. Waugh is eligible for reappointment to an additional term.
There is one current vacancy on this board.
Lawrence-Douglas County Metropolitan Planning Commission:
One (1) position (Emerling) expired 05/31/06. Dr. Emerling is eligible for reappointment to an additional term.
Mechanical Code Board of Appeals:
One (1) vacancy for the un-expired position, held by Frank Estrada, which expires 03/31/08.
Recycling and Resource Conservation Advisory Board:
One (1) vacancy for the un-expired position, held by Shannon Criss, which expires 12/31/07.
