JOINT ORDINANCE/RESOLUTION OF THE CITY OF LAWRENCE, KANSAS, AND THE BOARD OF COUNTY COMMISSIONERS OF DOUGLAS COUNTY, KANSAS, AMENDING THE JOINT SUBDIVISION REGULATIONS, CHAPTER 21 OF THE "CODE OF THE CITY OF LAWRENCE, KANSAS, 2003," AND AMENDMENTS THERETO, SPECIFICALLY AMENDING SUBDIVISION REGULATIONS PERTAINING TO BUILDING SETBACK LINES ON MAJOR STREETS OR HIGHWAYS.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS, AND,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DOUGLAS COUNTY, KANSAS:
WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission on April 17, 2006, discussed building setback lines on major streets and highways pursuant to Ch. 21, Article 1201, as those setbacks pertain to West 6th Street between Wakarusa Drive and Folks Road, and;
WHEREAS, after due and lawful notice the governing body of the City of Lawrence, Douglas County, Kansas held a hearing on June ___, 2006, pursuant to K.S.A. 12-765 and after due consideration and deliberation, the recommended change was approved.
WHEREAS, after due and lawful notice the recommendation came on for hearing before the Board of County Commissioners of Douglas County, Kansas on ________, 2006, and after due consideration and deliberation the recommended change was approved.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS, AND RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DOUGLAS COUNTY, KANSAS:
SECTION I. Chapter 21, Article 12, Section 21-1201, of the Code of the City of Lawrence, Kansas, 2003, is hereby amended to read as follows:
ARTICLE 12. BUILDING SETBACKS, ENFORCEMENT, EXCEPTIONS
21-1201. BUILDING OR SETBACK LINES ON MAJOR STREETS OR HIGHWAYS.
(A) Building and parking setback lines are hereby established on certain major streets or highways as follows: West Sixth Street from County Route 13 to Wakarusa Drive and West Sixth Street from Monterey Way to Folks Road: setback line of 50 feet.
(B) Building setback limits on West Sixth Street between Wakarusa Drive and Folks Road shall be based upon the approved zoning for each tract.
SECTION II. Section 21-1201 of the Joint Subdivision Regulations of the City of Lawrence, Kansas, and Douglas County, Kansas, is hereby repealed, it being the intent of this joint ordinance/resolution that these provisions be substituted in place thereof.
SECTION III. This joint ordinance/resolution shall be effective upon passage and publication as provided by law.
