Recommendations/Options/Action Requested:

 

Adopt two Resolutions of Support for two Low Income Housing Tax Credit Applications being submitted to the State of Kansas by Tony Krsnich for projects known as Penn Lofts and Delaware Coop.

 

Executive Summary:

Tony Krsnich is applying to the Kansas Housing Resource Corporation (KHRC) for the Low Income Housing Tax Credit (LIHTC) Program to construct affordable rental housing units in two separate projects, called Penn Lofts and Delaware Coop, on properties located at the southwest corner of 8th Street and Pennsylvania Street and at the northwest corner of Delaware Street and 9th Street. 

 

Penn Lofts - This proposed mixed use development is planned to contain 12,000 square feet of commercial/retail space and 72 apartment units, of which 75% (54 units) will be rent restricted to tenants who make less than 60% of the area median income.  The remaining 25% will be market rate units.

 

Delaware Coop – This proposed mixed use development is planned to contain 2,300 square feet of commercial/retail space and 15 residential units, of which approximately 87% (13 units) will be rent restricted to tenants who make less than 60% of the area medium income.

 

The projects are located within the Warehouse Arts District and are governed by the 8th and Penn Design Guidelines and overlay district.  Staff anticipates that these projects will require changes to the Design Guidelines and Staff will be working with the applicant to identify the process to pursue zoning entitlements for the project.  Such entitlements may include text amendments to the 8th and Penn Design Guidelines, rezoning, platting, site planning, and addressing the landmark designation of the Poehler Building to accommodate the Delaware Coop project.  The developer would submit applications for these entitlements if awarded the tax credits.

 

Mr. Krsnich is likely to seek other incentives on this project, including funds from the Affordable Housing Trust Fund (an unspecified amount at this time).  Any specific request for other types of incentives will be processed separately from this request for a resolution of support for Low Income Housing Tax Credits and such requests would be required to meet the updated policy provisions related to incentives.

 

KHRC is required to notify the chief executive officer of the local jurisdiction where the proposed development is located.  For their records, a Resolution from the local government stating their support for all such proposed developments using tax credits is also required. 

 

The Resolutions of Support only provide documentation that the City is aware of the project, supports the application, and is open to considering the project from a zoning entitlement perspective and other requests for incentives or assistance if the Low Income Housing Tax Credits are awarded.  Any request for incentives will be decided separately and this resolution does not indicate approval of any such request. Additionally, the projects must still go through the necessary development processes.
