RESOLUTION NO. 7185
A RESOLUTION OF THE CITY OF LAWRENCE, KANSAS, APPROVING CONDITIONALLY AN APPLICATION FOR LOW INCOME HOUSING TAX CREDITS FROM THE STATE OF KANSAS FOR "PENN LOFTS," A PROPOSED HOUSING DEVELOPMENT CONTAINING THREE PARCELS EACH ADDRESSED AS 800 PENNSYLVANIA STREET.
WHEREAS, Tony Krsnich, having a principal place of business at 832 Pennsylvania Street, Lawrence, Kansas, has informed the City of Lawrence, Kansas, that he will be filing a low income housing tax credit application with the Kansas Housing Resource Corporation for the proposed development of "Penn Lofts," which shall include affordable rental housing for individuals and families, on that real property bearing the following legal description, to-wit:
The northern lot addressed as 800 Penn (Plate U00088A):
8TH AND PENNSYLVANIA NEIGHBORHOOD REDEVELOPMENT TRACT OF LAND IN NE QR 31-12-20 & REPLAT OF LOTS 14,15,16,17,18,19,20,22,24,26,28,30,32,34 & 36 ON PENNSYLVANIA STREET & LOTS 1,3,5,7,9,11,13,15,17,19,21 & PART LOT 23 ON DELAWARE STREET & ALLOF LOT 1 & LOT 2 POEHLER ADD BLK 'C' LT 1

The southern lot addressed as 800 Penn (Plate U00101A):
PENNSYLVANIA STREET LT 27 (U00101 & 102 COMBINED 1988)
WHEREAS, the proposed mixed use development will contain 12,000 sq. ft. of commercial/retail and 72 dwelling units that will be constructed;
WHEREAS, the proposed housing portion of the development will consist of studio, one, two and three bedroom dwelling units;
WHEREAS, the proposed housing portion of the mixed use development shall include both market rate and affordable dwelling units to be marketed to individuals and families, with 75% of the 72 housing units targeting 60% of area median income range; and
WHEREAS, if application for low income housing tax credits is approved by the Kansas Housing Resource Corporation, Tony Krsnich may request assistance from the City of Lawrence Affordable Housing Trust Fund and other public assistance to aid in financing the project.
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:
SECTION 1: The above-stated recitals are incorporated herein by reference as if set forth in full.
SECTION 2: The Governing Body of the City of Lawrence, Kansas, supports the application of Tony Krsnich, having his principal place of business at 832 Pennsylvania Street, Lawrence, Kansas, for low income housing tax credits from the Kansas Housing Resource Corporation for a proposed low income housing development, “Penn Lofts," on that real property the legal description of which is set forth in the recitals, supra, subject to the following two conditions: (a) the housing development includes, at a minimum, all commitments, appointments, and amenities, as set forth in the recitals; and (b) the developer obtains all necessary land use, site plan, and building code approvals for the proposed housing development from the City of Lawrence, Kansas, Department of Planning and Development Services.
SECTION 3: The Governing Body hereby declares its intent to consider, but not commit to, requests for assistance made by Tony Krsnich for use of the city’s Affordable Housing Trust Fund funds and other types of assistance as may be requested by the applicant to construct the project.
SECTION 4: This Resolution shall be and remain effective until July 30, 2017. In the event that any of the described characteristics of the proposed housing development, as set forth in the recitals, supra, shall change prior to the issuance of a building permit, then this Resolution shall be deemed null and void.
