Accept dedication of right-of-way associated with Minor Subdivision, MS-19-00106, Fairfax Addition No. 3, located at 1236 Laura Ave. Submitted by Grob Engineering Services LLC, for Rebecca S. Gulley, property owner of record.

 

Executive Summary:

 

MS-19-00106 proposes a minor subdivision/replat of four platted lots of record currently addressed as 1236 Laura Avenue. The existing four lots were combined in 1988 for taxing purposes by Douglas County. The applicant proposes creating two platted lots. Both proposed lots conform to the density and dimensional standards for the RS7 (Single-Dwelling Residential) District as expressed by the Land Development Code.

 

Minor subdivisions/replats are generally an administrative process; however, MS-19-00106 requires dedication of right-of-way. Section 20-808(d)(4) of the Land Development Code requires applicants dedicate one-half of the additional right-of-way necessary to bright the adjacent road right-of-way into compliance. Local roads require 60 feet of right-of-way. Laura Avenue has 50 feet of platted right-of-way; therefore, the applicant is proposing to dedicate 5 feet of land to the Laura Avenue right-of-way. The applicant dedicated the additional right-of-way via separate instrument and it has been recorded at the Douglas County Register of Deeds in Plat Book 1166, Page 923.  

 

Planning Staff recommends acceptance of an additional five feet of right-of-way for Laura Avenue associated with minor subdivision, MS-19-00106.

 

The remainder of the minor subdivision/replat application will be processed administratively by Planning and Development Services staff.
