Recommendations/Options/Action Requested:

 

Accept vacation of utility easement and dedication of new easement, by separate instrument, for Rural Water District #13, associated with a minor subdivision, MS-19-00035, for Lawrence Municipal Airport Addition No. 3, located at 1910 N. Airport Rd. Submitted by Landplan Engineering Services and Hetrick Air Services Inc., on behalf of the City of Lawrence, property owner of record.

 

Executive Summary:

This proposed minor subdivision modifies interior lot lines to accommodate this specific proposed development. The rear portion of existing Lot 1 is encumbered by a regulatory setback directly associated with the airport operations. The rear 35 feet of the lot has building height restrictions to keep the parallel taxiway area clear of obstructions. Since this area is not buildable, the developer is not interested in leasing the area. Therefore, the rear area that is affected by the extraordinary setback is proposed as a tract in this minor subdivision. Lot 1 is expanded to the south into original lots 2 and 4 creating a desirable development parcel. The remaining portion of lots 2 and 4 are combined into a single lot for future development. There are no known projects for the remaining property within the boundary of the minor subdivision.

 

Rural Water District 13 has an active facility crossing the subject property. The water line will be relocated with this project. A new easement is required for this relocated water line. The Rural Water District requires this easement to be separately dedicated (from the City to the Rural Water District) and shows the location of the easement graphically. The separate instrument easement document would be recorded with the Register of Deeds Office with proper notation shown on the minor subdivision drawing.

 

The applicant has submitted a separate application for a site plan (SP-19-00029) for development of proposed Lot 1. The site plan requires consideration by the Airport Zoning Commission, which the Land Development Code designates the Lawrence Douglas County Metropolitan Planning Commission as the Airport Zoning Commission. They approved the site plat at their regular meeting on Monday, March 25, 2019.

 

The Planning Commission granted a variance regarding the construction of public sidewalk at their regular meeting on Monday, March 25, 2019.

 

The City Commission’s action on this request is to accept the vacation of utility easement as shown on the attached drawing and to approve the dedication of new easement, by separate instrument.
