Recommendations/Options/Action Requested:

 

Accept dedication of easements and right-of-way associated with a Minor Subdivision, MS-18-00535, for South Hills No. 3 Second Replat, for 1401 W. 23rd Street and 1300 W. 24th Street.

 

Executive Summary:

This minor subdivision is related to a redevelopment application submitted as part of the SmartCode. The minor subdivision proposes to consolidate two platted lots into a single lot, dedicate new utility and access easements, and dedicate new right-of-way.  

 

The Planning Commission considered this minor subdivision at their January 23, 2019 meeting to consider a variance related to right-of-way width. The existing width of W. 23rd Street along this property is 110 feet. The Subdivision Regulations require 150 feet of width. The Planning Commission voted 9-0 to approve the variance to allow the existing, reduced right-of-way width.

 

The Planning Commission discussed the need for an adequate area for construction of a wide pedestrian pathway along W. 23rd Street as part of the proposed infill community plan. Following the meeting the applicant submitted a revised preliminary plat that includes the proposed dedication of 10 feet of additional right-of-way along the north property line. This proposed dedication expands the total width of the right-of-way from 110 feet to 120 feet. The change reduces the burden of the variance by bringing the property closer to full compliance. The variance, granted by the Planning Commission, is still valid.

 

The dedication of the additional right-of-way improves the situation but does not alter the need for a variance as discussed by the Planning Commission.

 

Procedurally, a SmartCode rezoning follows the subdivision regulation requirements set out in Section 20-808 of the Land Development Code. This request has followed that process and therefore requires and is subject to City Commission approval to becoming effective. The SmartCode also requires approval of an infill community plan per Section 21-400 of the City Code. The infill community plan and rezoning applications have been submitted concurrently with this minor subdivision application and is forwarded for the City Commission’s consideration as a separate action item.
