Recommendations/Options/Action Requested:

 

Consider an appeal of staff’s determination on site plan no. SP-17-00192 and approve a revised site plan, as submitted by the applicant, that adds ten (10) parking spaces for the construction of two new Greek houses (Fraternity House use) located on property described as Lot 2, Sigma Nu Addition No. 2, located at 1500 and 1503 Sigma Nu Place, SP-17-00192.

 

Executive Summary:

An Administrative Determination was made on August 11, 2017 that approved a site plan application for the construction of two new Fraternity House uses to be located on the south end of Sigma Nu Place with a single driveway to the public street. The Site Plan met all required Development Code requirements, including providing the required number of off-street parking spaces, and was approved without conditions.

 

Due notice was provided to several neighbors, as requested, of the Administrative Determination. An appeal of the Determination was received on August 21, 2017 on behalf of the West Hills Homes Association. This Neighborhood is located immediately south of the subject property.

 

The concern of the appeal is the lack of off-street parking in the neighborhood to support the many Greek houses in the vicinity. The proposed development requires 77 off-street parking spaces for the proposed two buildings with a combined occupancy of 102 sleeping units. The project as proposed at the time of the Administrative Determination, included 81 off-street parking spaces. This site plan provided four spaces in excess of the minimum required for this use.

 

The applicant has met with neighborhood representatives to discuss concerns. A revised site plan that includes 91 off-street parking spaces was submitted on September 11, 2017 for the City Commission’s consideration.

 

The process established by the Land Development Code states that in the event of an appeal of the Director of Planning’s Determination of a Site Plan application the City Commission shall consider the item as a new matter and shall invite public comment. For this reason, the site plan is scheduled on the City Commission’s agenda as a regular item.

 

The City Commission shall consider and act on the application per section 20-1305 (j) and may take any of the following actions:

 

1.    Approve the application;

2.    Identify those modifications that would allow approval of the site plan application;

3.    Approve the application with conditions; or

4.    Disapprove the site plan application.

The applicant’s proposed revised site plan that adds ten additional spaces is code compliant for standards related to parking lot design and landscape requirements, though in most circumstances parking beyond the code required amount of spaces would need to be mitigated for its storm water impact.  In this instance, the additional parking is limited in number and appears to address the neighborhood’s concerns for the project to provide adequate parking for the new use.  Staff recommends that the City Commission approve the revised site plan as proposed by the applicant without mitigation of the additional parking spaces for their storm water impact.
