Oread Hotel Block Parties

 

 

On 07/06/10 the City Commission received a request from Thomas Fritzel, Oread Inn, LLC, for a temporary use of right-of-way permit to allow use of portions of the right-of-way on Indiana Street, 12th Street, and Oread Avenue near the hotel on the following dates:

The attached application, staff memo, and map were included on the 07/06/10 agenda.

 

The City Commission requested that the applicant prepare a detailed site plan to clarify certain aspects of the plan for future consideration by the Commission. In response the applicant has submitted the attached letter, community event exhibit plan (for the August 27 event) and tailgate event exhibit plan (for the rest of the events). The attached correspondence (updated 07/16/10) has been received regarding the request.

 

In communications with the applicant, staff has also received clarification on the following points:

§  For the community event, no extension of the licensed premises is requested.

§  For the community event, the applicant explained traffic control as follows: “During the event’s 3-hour duration, thru traffic will take alternate routes around the event area, similar to how it was done during the hotel’s construction.  South bound Indiana traffic will be diverted to Ohio at 11th Street and back to Oread Avenue at 13th street. The reverse would apply for North bound Oread Avenue traffic.  Westbound 12th street traffic would either be diverted to 11th or 13th streets. Oread neighbors in the 700 block of West 12th would be allowed to come up Indiana as the event boundaries would not extend West beyond the front of the hotel.”

§  For the tailgate events, the licensed premises would be extended into 12th Street ten feet beyond the South face of the planter at the Oread, allowing for a 24 foot drive lane for two-way traffic. 

§  For the tailgate events, the applicant will meet whatever requirements that Alcoholic Beverage Control (ABC) imposes regarding fencing off the event area to control the movement of alcohol.

§  “No parking” is requested during all of the events on both sides of Indiana adjacent to the hotel, on 12th Street in front of the hotel, and on both sides of Oread Avenue from 12th to 13th.

 

The applicant has requested permission to allow the temporary sale, possession and consumption of alcohol on the public right-of-way. Because the area is within 400’ of a school or church (Ecumenical Christian Ministries at 1204 Oread Avenue) if the City Commission wishes to approve the sale, possession and consumption of alcohol, it must hold a public hearing and find that the temporary event and the sale of alcohol is not adverse to the public safety and welfare, as well as adopt an ordinance allowing possession and consumption on the right-of-way. Per City Code Section 4-113(C), the church must be given at least 30 days notice of the hearing, therefore staff has notified the church that the public hearing will be held on July 27.

 

If the Commission wishes to authorize the events, staff recommends the following conditions be added to the right-of-way permit:

  1. Prior to issuance of the permit, applicant must complete any outstanding public improvement punchlist items, including but not limited to completion of the driveway approach at 1145 Indiana.
  2. Right-of-way shall be restored to pre-event condition immediately following the event.
  3. The Temporary Use of Public Right-of-Way Permit must be displayed on site during hours of operation.
  4. Temporary sign permit must be obtained from Development Services for any proposed temporary signage.
  5. The applicant shall provide trash receptacles or other sanitation provisions as needed
  6. Applicant shall contact the Fire Medical Department for inspection review during set up to be sure that adequate access to buildings, emergency vehicles and water connections is maintained.
  7. All other applicable city codes must be followed.

 

ACTION:       Authorize staff to approve a temporary use of right-of-way permit for the use of portions of the public right-of-way along Oread Avenue, 12th Street and Indiana Street on various dates in fall 2010 for the Oread Hotel block parties, if appropriate.
