Thomas Fritzel, Oread Inn, LLC, has requested a temporary use of right-of-way permit (see application) to allow the closure of portions of Indiana Street, 12th Street, and Oread Avenue near the hotel (see map) on the dates listed below:

From approximately 7:00 a.m. – midnight on the dates listed above, the applicant would close the streets as depicted on the map for family oriented block parties which would include food sales, alcoholic and non-alcoholic beverage sales, live entertainment, carnival games, inflatables, sales displays, exhibits and street vendors. “No parking” signs would be posted 3 days prior to each event. If a game date changes (for example, due to TV schedules) the corresponding event date would also change.

 

Staff notified adjacent property owners and the Oread Neighborhood Association of City Commission consideration of this item, and the applicant has been working with area residents and university officials on plans for the event.  

 

The applicant has proposed that vehicular traffic be limited to local residents, city and university buses, and emergency vehicles, but staff recommends total closure of the street. Emergency vehicles, of course, would still have access to the site and adjacent properties. Bus reroutes would be required, but they are normally rerouted out of that area on football game days anyway.

 

The applicant has planned the events to minimize city support needed. The applicant will provide private security, trash/litter control, and any necessary barricades/fencing. Final site layout plans will be subject to the approval of the Fire Medical Department.

 

The applicant has requested permission to allow the temporary sale, possession and consumption of alcohol on the public right-of-way in the event area. Because the area is within 400’ of a school or church (Ecumenical Christian Ministries at 1204 Oread Avenue) if the City Commission wishes to approve the sale, possession and consumption of alcohol, it must hold a public hearing and find that the temporary event and the sale of alcohol is not adverse to the public safety and welfare, as well as adopt an ordinance allowing possession and consumption on the right-of-way. Per City Code Section 4-113(C), the church must be given at least 30 days notice of the hearing, therefore staff has notified the church that the public hearing will be held on July 27.

 

Staff recommends the following conditions be added to the right-of-way permit:

  1. Prior to issuance of the permit, final site layout plans must be submitted to the city and approved by the Fire Medical Department.
  2. Prior to issuance of the permit, applicant must complete any outstanding public improvement punchlist items, including but not limited to completion of the driveway approach at 1145 Indiana.
  3. Right-of-way shall be restored to pre-event condition immediately following the event.
  4. The Temporary Use of Public Right-of-Way Permit must be displayed on site during hours of operation.
  5. Temporary sign permit must be obtained from Development Services for any proposed temporary signage.
  6. The applicant shall provide trash receptacles or other sanitation provisions as needed.
  7. Applicant shall contact the Fire Medical Department for inspection review during set up to be sure that adequate access to buildings, emergency vehicles and water connections is maintained.
  8. All other applicable city codes must be followed.

 

 

 

ACTION:       Authorize staff to approve a temporary use of right-of-way permit for the closure of portions of Oread Avenue, 12th Street and Indiana Street on various dates in Fall 2010 for the Oread Hotel street parties.
