RE:	Westdale Addition No. 4 Vacation of 15’ Utility Easement July 14, 2009 Regular Agenda Item

Please include the following item on the City Commission regular agenda for consideration at the July 14, 2009 meeting:

On July 14, 2009 the City Commission will open a public hearing to consider a request by owner Lawrence Reformed Presbyterian Fellowship (Christ Covenant Church), 2312 Harvard Road, Lawrence, KS 66049, for the vacation of a 15’ utility easement located between Lots 4, 9 and 5, 10, Westdale Addition No. 4 in the City of Lawrence.

The easement was platted in anticipation that the area would be developed with townhomes and the easement would be used to feed utilities to each residential unit. The townhomes were never built and the areas adjacent to the easement have one owner, Christ Covenant Church, which has utility service. The owner is planning to construct a building addition (2,000-5,000 s.f.) which would encroach into the existing easement.

All utilities, as well as city staff, have reviewed this request and have no objections. All property owners within 200 feet have also been notified and no objections have been received.

Action Requested: Hold public hearing and, pending discussion, approve order of vacation.
