BEFORE
THE GOVERNING BODY OF THE CITY OF
NOW on this 14TH
day of July, 2009, the above entitled matter comes for hearing before
the Governing Body of the City of Lawrence, Kansas.
THEREUPON, the
Governing Body examines the matter, hears comments on the petition and being
duly advised in the premises finds as follows, to-wit:
1. The Governing
Body has jurisdiction on the subject matter pursuant to K.S.A. 12-504 et
seq. as amended.
2. That notice of hearing of said petition and
the affidavit of publication thereof are examined and found to have been duly
made in strict conformity with the laws of the State of
3. That no private rights will be injured or
endangered by such vacation.
4. That no objection to said petition has been filed with the City Clerk at the time of or prior to the hearing.
5. That the City Clerk shall certify a copy of this Order to the Register of Deeds of Douglas County, Kansas, for recording as provided by K.S.A. 12-505, as amended.
IT IS THEREFORE, BY
THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS, CONSIDERED AND ORDERED that
the following described utility easement:
A permanent utility easement recorded in Plat
Book P15, Page 499, in the Office of the Douglas County Register of Deeds,
lying between Lots 4, 9 and 5, 10, Westdale Addition No. 4, an addition to the
City of Lawrence, Douglas County, Kansas, described as follows:
BEGINNING AT THE SOUTHEAST CORNER OF LOT 5
OF SAID ADDITION, THENCE ON AN AZIMUTH OF 192 DEGREES 53 MINUTES 15 SECONDS
COINCIDENT WITH THE EAST LINE OF LOT 10 OF SAID ADDITION, A DISTANCE OF 7.50
FEET; THENCE ON AN AZIMUTH OF 283 DEGREES 44 MINUTES 12 SECONDS, A DISTANCE OF
151.45 FEET; THENCE ON AN AZIMUTH OF 270 DEGREES 00 MINUTES 33 SECONDS, A
DISTANCE OF 0.10 FEET TO A POINT ON THE WEST LINE OF LOT 9 OF SAID ADDITION;
THENCE ON AN AZIMUTH OF 07 DEGREES 36 MINUTES 55 SECONDS COINCIDENT WITH THE
WEST LINE OF SAID LOT 9, A DISTANCE OF 7.57 FEET TO THE NORTHWEST CORNER OF
SAID LOT 9, THENCE ON AN AZIMUTH OF 00 DEGREES 10 MINUTES 32 SECONDS COINCIDENT
WITH THE WEST LINE OF LOT 4 OF SAID ADDITION, A DISTANCE OF 7.29 FEET; THENCE
ON AN AZIMUTH OF 103 DEGREES 34 MINUTES 58 SECONDS, A DISTANCE OF 152.14 FEET
TO A POINT ON THE EAST LINE OF LOT 5 OF SAID ADDITION; THENCE ON AN AZIMUTH OF

A DISTANCE OF 7.71 FEET TO THE POINT OF BEGINNING, SAID TRACT CONTAINING 2,249
