Approve a Special Use Permit, SUP-18-00572, and adopt on first reading, Ordinance No. 9642. The special use permit and ordinance would permit a non-owner occupied Short-Term Rental at 921 Holiday Drive. The rental use is limited to no more than four guestrooms and the occupancy is limited to no more than three unrelated adults. Submitted by Bingham Investment LLC, property owner of record. |

Executive Summary: |
Short-Term Rental uses were recently added to the Land Development Code as uses permitted in specific zoning districts. Short-Term Rental uses are permitted with licensing when they are accessory to owner occupied residences but require approval of a special use permit when they occur in non-owner occupied residences. Standard conditions for the use include a requirement that the property remain residential in character and that the use must be licensed with the City.
The subject property has four off-street parking spaces and one parking space is required for each guest room; therefore, a maximum of four guest rooms is permitted.
The property is located in the Holiday Hills No. 7 Planned Unit Development (PUD). Section 20-601(d) of the Land Development Code, Occupancy Limits, permits a maximum of three unrelated adults in detached dwellings and up to 4 unrelated adults in multi-dwellings constructed within a Planned Unit Development; therefore, the short-term rental use is limited to no more than three unrelated adults.
A valid protest petition was submitted; therefore, a super-majority vote (4 of 5) is required to approve the special use permit. |
