Recommendations/Options/Action Requested:

 

Consider adopting on first reading, Ordinance No. 9421, concerning the carrying of unconcealed firearms in any City-owned or City-leased building, if appropriate.

 

Consider adopting on first reading, Ordinance No. 9425, authorizing the City Manager to designate and post the required signs in buildings owned or leased by the City as buildings where the carrying of unconcealed firearms is prohibited, if appropriate.   

 

Executive Summary:

Proposed Ordinance No. 9421:

The City has prohibited the carrying of concealed and unconcealed firearms in City buildings under a temporary exemption provided for in the Personal and Family Protection Act (K.S.A. (2016 Supp.) 75-7c01 et seq.).  On January 1, 2018, the City’s ability to ban the carrying of concealed firearms will expire because the City will not have the adequate security measures required by statute at all public entrances to City buildings.  Provided the City installs the appropriate signs, the unconcealed carrying of firearms is prohibited under current state law.  Ordinance No. 9421 incorporates the relevant state law provisions related to the unconcealed carrying of firearms into our municipal code.  The ordinance also establishes a penalty for a person who enters a posted City building after being refused entry or who refuses to leave after being asked to leave.   

 

Proposed Ordinance No. 9425

This ordinance is merely a “companion” ordinance to Ordinance No. 9421.  It requires all buildings owned or leased by the City to be designated and posted as prohibiting the carrying of unconcealed firearms after the effective date of the ordinance (January 1, 2018).  It also strikes references to the temporary prohibition of the carrying of concealed firearms since the City’s exemption under the Kansas Personal and Family Protection Act expires December 31, 2017.

Fiscal Impact (Amount/Source):

The fiscal impact to the City is minimal.  The City will have to obtain and post signs prohibiting the carrying of unconcealed firearms in the city buildings.
