ORDINANCE NO. 9425

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, AMENDING CHAPTER 1, SECTION 305, OF THE CODE OF THE CITY OF LAWRENCE, KANSAS, 2015 EDITION AND AMENDMENTS THERETO, PERTAINING TO CERTAIN POWERS OF THE CITY MANAGER CONCERNING PROPERTY OWNED OR LEASED BY THE CITY OF LAWRENCE, AND REPEALING EXISTING CHAPTER 1, SECTION 305.

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION 1.  Chapter 1, Section 305 of the Code of the City of Lawrence, Kansas 2015 Edition and amendments hereto, is hereby amended to read as follows:

1-305               CERTAIN POWERS OF THE CITY MANAGER CONCERNING PROPERTY OWNED OR LEASED BY THE CITY OF LAWRENCE.

(a)        The City Manager shall have the authority to designate any all buildings or property owned or leased by the City of Lawrence, and any building or property open to the public and operated as a business premises by the City of Lawrence, as property as buildings where the carrying of a concealed handgun unconcealed firearms, as that term is defined at K.S.A. 2016 Supp. 75-7b01, as amended, is, under the provisions of the Kansas Personal and Family Protection Act of 2006, codified as amended at K.S.A. 75-7c01, et seq., restricted or prohibited. (Ord. 8048)

 

(b)        Upon such designation, the City Manager shall cause the premises to be posted in accordance with the rules and regulations of the Kansas Attorney General that are adopted under the authority of the Kansas Personal and Family Protection Act.  A list of the designated and posted buildings and properties shall be maintained and shall be open to public inspection during regular business hours. (Ord. 8048) The City Manager shall cause all buildings owned or leased by the City to be posted in accordance with rules and regulations promulgated by the Kansas Attorney General under authority of the Kansas Personal and Family Protection Act of 2006, as amended.

 

(c)        The City Manager and the City Manager’s designees are granted the authority, with good and lawful cause, to order any individual not to enter, to leave, or not to return to any property owned or leased by the City of Lawrence. (Ord. 8048)

 

(d)        The powers in this section are not an exclusive enumeration of the powers of the City Manager and are not meant in any way to impair the City Manager’s ability to exercise the other powers that he or she possesses.  (Ord. 8048)

SECTION 2. Existing Chapter 1, Article 3, Section 1-305 of the Code of the City of Lawrence, Kansas, 2015 Edition, and amendments thereto, is hereby repealed in its entirety, it being the intent of the Governing Body that this ordinance supersede the repealed Code section.

SECTION 3. If any section, sentence, clause, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance. 

SECTION 4. After passage, approval, and publication, as provided by law, this ordinance shall be in full force and effect commencing January 1, 2018.
