Executive Summary: |
An application was submitted by Margretta O. Farrar-de Vries, the property owner of record, to rezone approximately .6 acres located at 401 Elm Street from RS5 (Single-Dwelling Residential) District to MU (Mixed Use) District.
The property contains a two-story structure with a woodworking shop and a vacant residence on the first level, and an occupied residence on the second level. The woodworking shop is classified as a Manufacturing & Production, Limited use in the Land Development Code. This use is not permitted in the RS5 District. The rezoning was requested as a mechanism to bring the existing woodworking shop into compliance. The rezoning would also facilitate the development of the vacant first floor residential space into a retail space. The existing second floor residence would continue to be a permitted use with the rezoning.
The Mixed Use District requires that Development Zones be designated with rezoning requests. The Development Zones are hierarchical in terms of development intensity and the zones consist of Primary, Secondary, and Tertiary. Given the surrounding residential uses, the subject property would be designated a Tertiary Development Zone.
The rezoning request is accompanied by a Text Amendment, TA-17-00495, which was initiated by the Planning Commission at their August 23, 2017 meeting to permit some nonresidential uses in the Tertiary Development Zone of the Mixed Use District. The proposed text amendment would permit the Manufacturing & Production, Limited and the Retail, General uses in the Tertiary Development Zone with approval of a Special Use Permit.
This rezoning request is accompanied by a Special Use Permit, SUP-17-00496, for the Manufacturing & Production, Limited and Retail, General uses.
The Planning Commission considered the item at their September 27, 2017 meeting and voted unanimously to forward the rezoning request to the City Commission with a recommendation for approval. |
