Authorize the Mayor to execute Supplemental Agreement No. 6 with the Kansas Department of Transportation for reimbursement of state funds for the Dillons Driveway 23rd Street Access Management project.   Authorize City Manager to execute Development Agreement with Dillon Companies, Inc.  

 

Executive Summary:

Project History

In April 2004, the city was awarded an Economic Development Grant from the Kansas Department of Transportation (KDOT) for consolidation of access points along 23rd Street from Iowa to Louisiana. Consolidation of access points improves traffic flow and safety. According to the city-state agreement, KDOT would pay 75% of actual construction costs up to a maximum of $500,000 while City costs would include engineering, right-of-way, utilities and 25% of construction costs.

 

The original project plan was to consolidate access points at some thirty different locations. Due to lack of participation by business/property owners, the original project never moved to the construction phase. Staff has been working to consolidate and reconfigure access driveways whenever opportunities arise, typically during redevelopment. Following are the eleven projects completed so far:

  7. 2246 Ohio Driveway

 

Of the original $500,000 grant $103,513 in state funds remain for future access improvement projects.  This Dillons driveway project would exhaust the remaining funds and complete this contract. 23rd Street is no longer state highway K-10.

 

Project Details – Dillon Driveway

The Dillon grocery store at 1015 W. 23rd Street is making site developments to the property. Pending a development agreement between the owner and the city, the owner promises to consolidate (2) driveways on 23rd Street to (1) driveway. A right turn lane will also be constructed from 23rd Street leading to the new driveway into the Dillon property. KDOT has drafted a supplemental agreement No. 6 to include this project.

Fiscal Impact (Amount/Source):

The recommended action will have a neutral net cost impact on the City. The cost estimate for construction is $113,279. All project costs will be paid upfront by the property owner.  After completion of the project, the City will reimburse the property owner for actual construction costs up to a maximum amount of $103,513 which will be funded with street maintenance funds.  Under the City/State agreement for the 23rd Street Access Management project, KDOT will then reimburse the City 100% of the total amount up to a maximum of $103,513 for the project.  All construction costs over that maximum amount will be incurred by the owner.
