Recommendations/Options/Action Requested:
Conduct a public hearing regarding distance a limitation waiver request for the 2017 Kansas State Fiddling and Picking Championships event to be held on Sunday, August 27, 2017, from 9:00 a.m. to 6:00 p.m. The public hearing would apply to Massachusetts Street between North Park and South Park Streets. Find that the proximity of the temporary sale of alcoholic liquor for the event is not adverse to the public welfare or safety and a grant distance limitation waiver. Adopt on first reading, Ordinance No. 9378, allowing the sale, possession and consumption of alcohol in the public right-of-way on Massachusetts Street between North Park and South Park Streets on Sunday, August 27, 2017, from 9:00 a.m. to 6:00 p.m. during the event.
Executive Summary:		The Kansas State Fiddling and Picking Championships have applied for a street event temporary use of right of way permit for its 2017 event, which will be held Sunday, August 27, 2017, from 9:00 a.m. to 6:00 p.m. The event will close Massachusetts Street between North Park and South Park Streets The request to sell, possess and consume alcohol within the public right of way has been reviewed pursuant to City of Lawrence Code, Chapter IV, Article 1, Section 4-113. The event was found to be within 400 feet of a church or school. Pursuant to code requirements, staff has notified the churches on June 22, 2017, that a public hearing regarding this request will be held on August 1, 2017, at the City Commission Meeting. Event notification was sent out for the event to adjacent property owners advising them of the event as well as being on the August 1, 2017, City Commission meeting  agenda. In addition to this notice, coordination with Parks and Recreation, Public Works, Police, Fire/Medical, Lawrence Transit, Downtown Lawrence, Inc., eXplore Lawrence, and Lawrence Association of Neighborhoods was completed with no issues being identified.
