The staff presents three alternative actions for the City Commission’s consideration of the request to authorize the purchase of Block 1, Lot 9, and the donation of Tract A, in the Burroughs Creek 2nd Addition Subdivision from Struct/Restruct, LLC, for $58,000 for preservation of the majestic bur oak tree and addition of open park land to Brook Creek Park.
1. Approve the request pursuant to the agreements presented on June 6, 2017.
2. Approve the request contingent on completion of an environmental assessment establishing a satisfactory baseline environmental condition of the property.
3. Deny the requested purchase.

Executive Summary: |
At the June 6 Lawrence City Commission meeting, the City Commission deferred Consent Agenda Item No. 12, (Authorize the purchase of Block 1, Lot 9, and the donation of Tract A, in the Burroughs Creek …) and directed staff to revisit environmental issues concerning the property purchases. After requesting clarification from the appraiser, discrepancies in the appraiser’s report for Lot 9 pertaining to previous environmental assessments were removed.
The staff approached the seller to negotiate adding language to the property purchase / donation agreements that protect the City’s interests if environmental contamination is discovered on the properties in the future. The seller is not agreeable to this language. The seller would like the Commission to still consider the agreements at its June 20, 2017 meeting, although the staff cannot make a positive recommendation on the agreements as written due to the absence of language that indemnifies the city in the event that future environmental remediation might be required.
If the Commission desires to consider purchasing the property and accepting the donation under alternative action number two (above), the staff will proceed with an environmental assessment of soil and groundwater conditions sufficient to establish a satisfactory baseline condition of the property regarding any potential pollutants.

Fiscal Impact: |
The fiscal impact to the City is $58,000. This purchase will be paid from the 2017 Parks and Recreation general fund budget. Additional funding will be required to complete the environmental assessment under the second alternative recommendation.
