Recommendations/Options/Action Requested:

 

Receive Request for Annexation No. A-17-00265 and, if appropriate, refer the request to the Lawrence-Douglas County Planning Commission for consideration and recommendation and authorize the City Manager to give statutory notice to Westar Energy of the City’s intent to annex the subject property.

 

Executive Summary:

Armstrong Management, LC and Grisham Management, LC, the owners of record of approximately 95.442 acres located along the east side of Highway 59 (S. Iowa Street) and the south side of N. 1250 Road (Armstrong Road) and west of E 1350 Road (Michigan Street) at the southeast corner of the intersection of Highway 59 and K10 Highway (“the subject property”), has petitioned the City, by filing Request for Annexation, No. A-17-00265, to annex the subject property to facilitate future commercial development and open space uses on the subject property.

 

Since the subject property adjoins the City limits and the owner of record has, by filing Request for Annexation, No. A-17-00265, petitioned the City for annexation, the City may, under K.S.A.  2015 Supp. 12-520(a)(7), annex the subject property.

 

Pursuant to City policy, the City Commission refers requests for annexation, where the area of the property to be annexed exceeds 10 acres, to the Lawrence-Douglas County Metropolitan Planning Commission for consideration and recommendation. The area of the subject property exceeds 10 acres.

 

Additionally, because the subject property is located in the certified territory of Westar Energy, before the City may annex the subject property, the City must, under K.S.A. 66-1,176, provide written notice to Westar Energy of its intent to annex the subject property. It should be noted that giving notice of intent to annex the subject property under K.S.A.  66-1,176 does not obligate the City to annex the subject property.

 

The subject property is not located within the territory of a Rural Water District. Therefore, notice to a Rural Water District is not required.

 

In summary, at this time, the City Commission will not take any final action on Request for Annexation, No. A-17-00265. Rather, the City Commission will receive the Request for Annexation and, if appropriate, refer the request to the Planning Commission for consideration and recommendation and authorize the City Manager to give statutory notice to Westar Energy of the City’s intent to annex the subject property.
