Executive Summary: |
This text amendment to the Land Development Code, Chapter 20, amends various sections of Article 13 to increase required notice to nearby property owners of development applications from 200 feet to 400 feet. The protest provisions outlined in KSA 12-757 which limits the petitions for Zoning and Special Use Permit applications to property owners within 200 feet remains.
The amendment clarifies posting requirements for Urban Conservation Overlay District rezoning applications. The amendments also include housekeeping corrections related to terminology and section references throughout the article.
The Planning Commission considered this item at their October 24, 2016 meeting and voted unanimously to forward the text amendment to the City Commission with a recommendation for approval.

Fiscal Impact (Amount/Source): |
The fiscal impact to the City is unknown. The amendment recognizes that there will be an increase in costs associated with these new requirements. In order to recover mailing and notification costs incurred by the City, the amendment includes authority for the City Commission to establish a reasonable mailing fee to be paid by the applicant. Planning and Development Services will be reviewing this fee during next year’s overall department fee review. There is no fee proposed with this amendment, only the authority to create one in the future.
