RE:

Pie Five Development Agreement

Authorize City Manager to execute Development Agreement

Project Details – Pie Five

A site plan has been submitted to the city for the construction of a Pie Five restaurant on the southeast corner of 25th & Iowa. As a condition of site plan approval, the owner has agreed to reimburse the city for the cost of constructing a concrete median on 25th Street east of Iowa.  The concrete median is an access control measure identified through the traffic impact study that controls vehicular ingress and egress to the property with its close proximity to the signalized intersection of 25th & Iowa.  This does not include the costs of designing and planning. The concrete median will be constructed as part of a separate KLINK mill and overlay project along Iowa Street that the city will be constructing this summer. This concrete median is shown on the attached Exhibit A.

Project Costs / Funding

The city has agreed to include the concrete median construction as part of its KLINK project this summer, with the developer contributing a maximum of $3,971.00 toward the construction of the median. This amount was estimated by city staff for construction costs only. All project costs will be paid upfront by the city.  After completion of the project, the city will be reimbursed for the median construction up to a maximum of $3,971.00.

Project Schedule

Construction of the concrete median will be included with the KLINK mill and overlay project along Iowa Street this summer. The KLINK project plans are currently in final design phase and will be sent out to bid this spring. Construction is expected to start sometime in June.
