RE:	Helm Subdivision (PF-12-12-10) Variance request from City Code 19-214(B)

Please include the following item on the City Commission agenda for consideration at the January 18, 2011 meeting:

Approval of the request by Glen and Carla Helm for a variance from 19-214B of the City Code which states that a private sanitary sewer service line shall not be located in a City public right of way for greater than 15 feet for 700 and 761 Elm Street.

Glen and Carla Helm recently submitted a final plat request, PF-12-12-10, for the property located at 700 and 761 Elm Street.

761 Elm Street is currently occupied by a single building which is legally served by sanitary sewer. While the existing sanitary sewer line will not be modified as part of the plat request; the existing sanitary sewer service line will extend more than 15 feet within dedicated right-of-way and this variance request will bring the property at 761 Elm Street into compliance with current City Code.

700 Elm Street is currently undeveloped and has legal access to sanitary sewer located in the Elm Street right-of-way along its frontage. Future sanitary sewer service to the property will extend more than 15 feet within dedicated right-of-way and this variance request will bring the property at 700 Elm Street into compliance with current City Code.

Action Request:

Approval of the requested variance from 19-214B of the City Code for 700 and 761 Elm Street.
