821 Iowa Street (SP-06-33-10) Waiver request from City Code 19-214(B)

Please include the following item on the City Commission agenda for consideration at the August 24, 2010 meeting:
Approval of the attached request by Cornerstone Architects, on behalf of the owner of the property at 821 Iowa Street, Xin Li Liu, for a waiver from 19-214B of the City Code which states that a private sanitary sewer service line shall not be located in a City public right of way for greater than 15 feet.
Xin Li Liu, the property owner of 1530 W. 6th Street, recently submitted a site plan application to change the building use to a restaurant. The building’s existing sanitary sewer service line connects to a public sanitary sewer manhole approximately 144 feet north of the property. The sanitary sewer service line is located approximately 200 feet along and within the Iowa Street right of way. While the service line will not be modified as part of the current redevelopment, the requested waiver does bring the property into compliance with the current code. Future redevelopment of the site shall require sanitary sewer service connection comply with City Code 19-214B.
Action Request. Department of Utilities staff requests the City Commission’s approval of the requested waiver from 19-214B of the code for 821 Iowa Street.
