On 07/20/10 the City Commission authorized staff to approve a temporary use of public right-of-way permit for the Oread Hotel block parties on the following dates:

The applicant has requested permission to allow the temporary sale, possession and consumption of alcohol on the public right-of-way on all of those dates except for 08/27/10. See the attached site plan for the events, in which the crosshatched area is the right-of-way where alcohol would be allowed. Because the area is within 400’ of a school or church (Ecumenical Christian Ministries at 1204 Oread Avenue), if the City Commission wishes to approve the sale, possession and consumption of alcohol, it must hold a public hearing and find that the temporary event and the sale of alcohol is not adverse to the public safety and welfare, as well as adopt an ordinance allowing possession and consumption on the right-of-way. Per City Code Section 4-113(C), the church must be given at least 30 days notice of the hearing, therefore staff notified the church that the public hearing would be held on July 27. The church has not submitted any comment to date regarding the request.
ACTION: Hold a public hearing; find that the temporary event and sale of alcoholic liquor is not adverse to the public safety and welfare; approve a distance restriction waiver; and adopt on first reading Ordinance No. 8553, allowing the temporary sale, possession and consumption of alcoholic liquor on specified city property for the Oread Hotel Block Parties.
