B. CONSENT AGENDA:

NOTE: All matters listed below on the Consent Agenda are considered under one motion and will be enacted by one motion. There will be no separate discussion on those items. If discussion is desired, that item will be removed from the Consent Agenda and will be considered separately.

1. Receive minutes from various boards and commissions:

Lawrence-Douglas County Bicycle Advisory Committee meeting of 01/19/10

Community Commission on Homelessness meeting of 01/12/10

Community Development Advisory Committee meetings of 01/14/10 and 01/28/10

Sales Tax Audit Committee meeting of 12/10/09

2. Approve all claims. The list of approved claims will be posted to the agenda the day after the City Commission meeting.

3. Approve licenses as recommended by the Department of Administrative Services.

4. Approve appointments as recommended by the Mayor.

5. Adopt the following ordinance(s) on second and final reading:

a) Ordinance No. 8491, regulating the licensing and operation of pedicabs within the City of Lawrence.

b) Ordinance No. 8489, for rezoning (Z-12-30-09) of approximately 8.71 acres from RS7 (Single-Dwelling Residential) to RMO (Multi-Dwelling Residential-Office), located at 3312 Calvin Drive (PC Item 1; approved 7-0 on 1/25/10)

c) Ordinance No. 8490, for rezoning (Z-11-20-09) of approximately 2.98 acres from U (Urban Reserve) to CO (Office Commercial), located at 525 Wakarusa Drive. (PC Item 9; approved 8-0 on 1/27/10)

6. Approval to proceed with Development Code applications for the proposed Bowersock Hydroelectric Plant on the north side of the Kansas River. Staff Memo

C. CITY MANAGER’S REPORT: None.

ADDRESSING THE COMMISSION: The public is allowed to speak to any regular agenda item or give public comment after first being recognized by the Mayor. Individuals are asked to come to the microphone, sign in, and state their name and address. Speakers should address all comments/questions to the Commission.

D. REGULAR AGENDA ITEMS:

1. Receive letter from Bert Nash Community Mental Health Center regarding program cuts and consider authorizing the City Manager to amend the contract to reflect three homeless outreach workers. This item was deferred form the 01/26/10 City Commission Meeting. Staff Memo & Attachments 01/26/10 Correspondence

ACTION: Authorize the City Manager to amend the contract with Bert Nash Community Mental Health Center to reflect three homeless outreach workers, if appropriate.

2. Consider extending the time period for a Special Use Permit (SUP-10-10-09) for Lawrence Community Shelter, located at 214 W 10^th Street/944 Kentucky Street. Submitted by Lawrence Community Shelter, for James Dunn, property owner of record and consider adopting on first reading, Ordinance No. 8493, for Special Use Permit (SUP-10-10-09) for Lawrence Community Shelter, located at 944 Kentucky St. (PC Item 11; approved 8-0 on 1/27/10) Because a valid protest petition has been received, approval of this item requires a supermajority vote (at least 4 votes). 3. Consider authorizing the Mayor to sign a letter to the Lawrence Board of Education. Revised Letter - Added 02/23/10

H. CALENDAR: Meeting List

1. Staff is working on coordinating possible meeting dates for the following items: meeting with Kaw Drainage District and NIMS emergency management training

· Oread Hotel grand opening, Saturday, February 20. Time 5:30 p.m. (This is an invitation only event)

· School Board Public Forum, Monday, March 1, 7:00 p.m. Location: Central Junior High School.

· School Board Public Forum, Tuesday, March 2, 7:30 p.m. Location: West Junior High Auditorium.

· Eggs & Issues, hosted by the Lawrence Chamber of Commerce, Saturday, March 6, 8:00 – 9:30 a.m. Location: Pachamama’s, 800 New Hampshire.

· City Commission meeting schedule for March 16 is cancelled due to spring break.

· City Commission will meet on March 30. Typically the fifth meeting of the month is cancelled however since the meeting on March 16 is cancelled, the March 30 meeting is reinstated.

· Inauguration of Chancellor Bernadette Gray-Little, 17^th Chancellor of the University of Kansas, April 11, 2010.

· State of the City Address and Mayoral Elections, Tuesday, April 13.

I. CURRENT VACANCIES – BOARDS/COMMISSIONS:

Listed below are existing and upcoming vacancies on City of Lawrence Boards and Commissions. Board of Electrical Appeals:

Two positions will expire 03/31/10. One is eligible for reappointment and one is completing a second full term. One must be a representative from the Fire Department.

Board of Zoning Appeals/Sign Code Board of Appeals:

One vacancy for a position that expires 09/30/12

Contractor Licensing Board:

One position expired 12/31/09. This position is required to be held by a representative from the Board of Electrical Appeals.

Historic Resources Commission:

Two positions will expire 03/01/10. Both have served two full terms and are not eligible for reappointment.

Human Relations Commission:

Two vacancies for positions that expire 09/30/11.

Jayhawk Area Agency on Aging:

Two (2) vacancies on the Board of Directors that expired 09/30/08 and 09/30/09.

Lawrence Cultural Arts Commission:

One vacancy for a position that expires 01/31/11.

Lawrence Douglas County Advocacy Council on Aging:

Four positions are currently vacant.

Mechanical Code Board of Appeals:

One position that will expire 03/31/10 and is not eligible for reappointment.

Public Transit Advisory Committee:

One (1) position that expired 12/31/09 and one (1) vacancy for a position that expires 12/31/10.

Sister Cities Advisory Board:

One (1) vacancy for a position that expires 12/31/11.
