RE:	1223 Ohio Street (SP-11-51-09) Variance request from City Code 19-214(B)

Please include the following item on the City Commission agenda for consideration at the February 2, 2010 meeting:

Approval of the attached request by Dan Hermreck Residential Design, on behalf of the owner of the property at 1223 Ohio Street, Odyssey Rentals, LLC, for a variance from 19-214B of the City Code which states that a private sanitary sewer service line shall not be located in a City public right of way for greater than 15 feet. 

Odyssey Rentals, LLC, the property owner of 1223 Ohio Street, recently submitted a site plan application to convert the existing vacant 4 or 5 bedroom, 2 bath residence into a 6 bedroom boarding house. The building’s existing sanitary sewer service line connects to the public sanitary sewer main located approximately 24 feet into the Ohio Street right of way. While the service line will not be modified as part of the current redevelopment the requested variance does bring the property into compliance with the current code.

Action Request. Department of Utilities staff requests the City Commission’s approval of the requested variance from 19-214B of the code for 1223 Ohio Street.
