RE:	Jo Shmo’s Sidewalk Dining and Hospitality License

Jo Shmo LLC, d/b/a Jo Shmo’s, 724 Massachusetts Street, has recently applied for a Sidewalk Dining and Hospitality License and has submitted all required documents.  An approved site plan is already on file and a new site plan is not required because the proposed sidewalk dining and hospitality area is in the same location as it was previously located. The applicant did submit a new railing design which has been reviewed and approved by the Historic Resources Commission.

The applicant has met the necessary requirements to obtain a sidewalk dining and hospitality license. In addition, the applicant requested that its patrons be allowed to possess and consume alcoholic beverages in the outdoor seating area.  Jo Shmo’s drinking establishment license was approved on January 20, 2009. Attached is Ordinance 8457, which, after its effective date, would allow possession and consumption of alcoholic beverages on the sidewalk dining and hospitality portion of city right-of-way. 

Staff recommends approval of the sidewalk dining and hospitality license for Jo Shmo LLC, d/b/a Jo Shmo’s, and adoption of the related ordinance.

ACTIONS:      Approve sidewalk dining and hospitality license for Jo Shmo’s, 724 Massachusetts Street.  

Adopt on first reading, Ordinance No. 8457, allowing possession and consumption of alcoholic beverages on certain city property pursuant to Jo Shmo’s Sidewalk Dining and Hospitality License.
