RE:	Angler’s Seafood House Sidewalk Dining and Hospitality License

Drake’s Snack Shop LLC, d/b/a Angler’s Seafood House, 1004-1006 Massachusetts Street, has recently applied for a Sidewalk Dining and Hospitality License and has submitted all required documents.  The related revised site plan is SP-6-37-08. Because of the building layout for Drake’s Snack Shop LLC, the applicant was allowed by the State to license the drinking establishment portion under another business name.  Southern Cuisine will be serving as a drinking establishment for Angler’s Seafood House and The Orient Vietnamese Cuisine and is planning to offer alcoholic beverages to their customers. Southern Cuisine’s drinking establishment license was approved on January 22, 2008.

The applicant has met all necessary requirements to obtain a sidewalk dining and hospitality license. In addition, the applicant requested that its patrons be allowed to possess and consume alcoholic beverages in the outdoor seating area.  Accordingly, attached is Ordinance 8412, which, after its effective date, would allow possession and consumption of alcoholic beverages on this portion of city right-of-way. 

Staff recommends approval of the site plan and sidewalk dining license for Nghia-Thi Nguyen (a.k.a. Nancy Nguyen) d/b/a Angler’s Seafood House and adoption of the related ordinance.

ACTIONS:      Approve Site Plan SP-6-37-08, for a sidewalk dining area for Angler’s Seafood House, located at 1004-1006 Massachusetts Street. Submitted by Jeff Lewis for Berkeley Company LC, the property owner of record.

Adopt on first reading, Ordinance No. 8412, allowing possession and consumption of alcoholic beverages on certain city property pursuant to Angler’s Seafood Sidewalk Dining and Hospitality License.
