ORDINANCE NO.  8412

AN ORDINANCE ALLOWING THE POSSESSION AND CONSUMPTION OF ALCOHOLIC BEVERAGES ON CERTAIN CITY PROPERTY PURSUANT TO SECTION 4-105 OF THE CODE OF THE CITY OF LAWRENCE, KANSAS AND PURSUANT TO A SIDEWALK DINING AND HOSPITALITY LICENSE FOR ANGLER’S SEAFOOD HOUSE, 1004-1006 MASSACHUSETTS STREET.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

Section 1.        From and after the effective date of this ordinance, the possession and consumption of alcoholic beverages is permitted in the public right of way described as follows:  

The Sidewalk Dining area consists of a 6’-0” deep area starting along the west most edge of lot ninety-six (96) continuing 51’ along the west most edge of Lot Ninety-six (96) and the south half of Lot Ninety-four (94), extending to a seven foot by eight foot area that is setback seven feet from the remaining area on the north half of Lot Ninety-four (94) on Massachusetts Street, in the City of Lawrence, Douglas County, Kansas, containing approximately 398 square feet.

All pursuant to Section 4-105 of the Code of the City of Lawrence, Kansas, 2009 Edition. Provided, that the possession and consumption of alcoholic beverages on the above described property shall be pursuant to all applicable State and City laws, including but not limited to the requirements of the sidewalk dining license granted for the property.

Section 2.         This ordinance shall be effective from and after its publication as provided by law.
