Please include the following item on the City Commission regular agenda for consideration at the July 21, 2009 meeting: Public Hearing to consider the proposed assessments and approve Ordinance 8432 levying the assessments for public improvements completed for the Delaware Commons Addition.
Project History.
In April 2006 the owners of the property requested that a benefit district be formed for the public improvements that were needed for the Delaware Commons Addition. Those improvements included extending sanitary sewer, stormwater improvements and placing/constructing sidewalk. The City Commission approved Resolution 6637 directing the improvements to be completed. The development would pay 100% of the cost of the improvements.
The development provided the City with engineering and construction contracts. The projects were completed in 2007. A maximum assessment ordinance was not completed.
Project Status.
The final cost for the stormwater and sidewalk improvements is $80,800.79, and sanitary sewer improvements are $95,669.25. The total cost of both is $176,470.04. The method of assessment was square footage based on the portion/percentage of each unit to the total square footage of the development.
All property owners of record in the benefit district were notified of this meeting. One owner did request addition information. Owners will have a 30-day period to pay the assessment; otherwise, the assessment will be added to the property tax.
Action Requested. Conduct public hearing and, pending public comment, approve if appropriate, Ordinance 8432 levying the assessments to pay the costs of construction for improvements made for the Delaware Commons project.
