RE:

Fairfield East Addition No. 1 Benefit District - PW0915

Repeal Resolutions 6831 and 6832

July 14, 2009 Consent Agenda Item

Please include the following item on the City Commission consent agenda for consideration at the July 14, 2009 meeting:

Project History.

On March 3, 2009 the City received a petition for street, water and sanitary sewer improvements for Fairfield East Addition No. 3.

On April 17, 2009 City Commission received the petitions and approved Resolution 6831 and 6832 setting out the findings and directing the improvements to be completed.

On May 8, 2009 the plat was filed, however, the name was changed to Fairfield East Addition No. 1.

On July 7, 2009 the City received a revised petition reflecting the plat name change.

The purpose of this agenda item is to correct the benefit district plat name so that when the projects are completed and ready to assess the correct legal descriptions will be identified.  The change is due to the fact that the plat was filed  under the title Fairfield East Addition No. 1previously titled  Fairfield East Addition No. 3.

Project Description.  The proposed project will include street, curb and gutter, sidewalks, water main, sanitary sewer main, and lift station/force main for the development.  The benefit district will pay 100% of the cost of the improvements.  No city funds will be used.

Method of Assessment:

Streets, sidewalk, water main, front footage

       Estimated cost:

$1,666,700.00

Sanitary sewer/force main – square footage

       Estimated cost:

$   450,000.00

Project Status.  Design work has begun.  Construction is expected to begin this year.  Both the petition and resolutions have been reviewed by Bond Counsel.

Action Request.

1.     Receive petitions and approve Resolutions 6842 and 6843 setting out the findings and determinations of the Governing Body and directing the improvements to be completed.

2.     Repeal Resolutions 6831 and 6832

Respectfully submitted,

Charles F. Soules, P.E.

Director of Public Works
