Please include the following item on the City Commission consent agenda for consideration at the April 14, 2009 meeting:

Project Description/History.  The 2008 Microsurfacing Program project was part of the 2008 contracted pavement maintenance program.  Ballou Construction Co., Inc. was contracted to perform the work.  The work included the patching and microsurfacing of multiple streets in the bound area generally described as between Kasold Dr and Iowa St from W 19^th St to W 31^st St.  All of the patching on the contract was performed and approximately 15% of the microsurfacing was also completed.  The microsurfacing work was suspended due to weather conditions and will resume April 14, 2009 contingent upon the weather.

As part of an agreement between the City and Ballou Construction, in consideration of the project suspension, the Contractor guaranteed to maintain bid item pricing for the microsurfacing application at $2.30 per square yard for an extended project, of equal size and scope, if the City chose to increase project quantities.  Recently, in 2009, a Kansas City area community received bids on the like microsurfacing application at various costs that exceeded $2.80 per square yard.  The City would see a significant cost savings for the proposed extended project that includes over 160,000 square yards of treated pavement.  Areas for proposed microsurfacing in 2009 have been identified and are included in an attachment as extended project locations to the 2008 Microsurfacing Program.

Project Funding.  The current contract amount is $570,252.70.  The proposed 2009 Microsurfacing Program project locations were part of the city’s 2009 pavement maintenance program that was reviewed and approved by City Commission on January 27, 2009.  This contract was included in the 2009 Street Maintenance Program for Microsurfacing to be paid from the gas tax fund.

Action Request.  Approve Change Order No. 4 to Ballou Construction Co., Inc. in the amount of $448,621.00.
