Please include the following item on the City Commission consent agenda for consideration at the April 7, 2009 meeting:
Project History. On March 3, 2009 the City received a petition for street, water and sanitary sewer improvements for Fairfield East Addition No. 3.
The City’s development policy (Resolution 5614) requires that when a petition has been filed requesting special assessment financing to install eligible public improvements in newly developed areas that the petitioners/developer provide the City not less than 25% of the estimated engineering costs in either cash or a letter of credit to the City prior to the City incurring any monetary obligation for the engineering work. The developer is requesting that the City Commission waive that development policy requirement.
Project Description. The proposed project will include street, curb and gutter, sidewalks, water main, sanitary sewer main, and lift station/force main for the development. The benefit district will pay 100% of the cost of the improvements. No city funds will be used.

Project Status. Attached is a proposed/tentative project schedule and executed petitions. Both the petition and resolutions have been reviewed by Bond Counsel.
Action Request.
1. Receive petitions and approve Resolution No. 6831 and Resolution No. 6832 setting out the findings and determinations of the Governing Body and directing the improvements to be completed.
2. Waive, if appropriate, the City’s requirement for the petitioners/developer to provide in advance to the City not less than 25% of the estimated engineering costs of the project prior to the City obligating funds.
