Lot 1A Maple Lawn Addition (minor subdivision MS-02-01-09) Ordinance Variance Request

 

Please include the following item on the City Commission consent agenda for consideration at the March 31st meeting:

Approval of the request by Grob Engineering, on behalf of the property owner of Lot 1A Maple Lawn Addition, for a variance from 19-214B of the code which states that a private sanitary sewer service line shall not be located in a City public right of way for greater than 15 feet. 

The current property owner of Lot 1A Maple Lawn Addition submitted an application to the planning department to adjust the lot line between Lot 1 and Lot 2 of Maple Lawn Addition so that Lot 1 (now called Lot 1A) is buildable.  The future sanitary sewer service line will cross Barker Avenue to connect to the nearest public sanitary sewer main. 

City Code 19-214(B) states that a private service line shall not be located in a City public right of way for a length of greater than 15 feet.  City code 19-214(E) states that provision of this city code section may be waived by the City Commission.

Staff from the Department of Utilities has reviewed, and approved of, the proposed routing of sanitary sewer service connection to the existing sanitary sewer main located in the Barker Avenue right of way. The service connection of the infill development in this manner is consistent with the existing residences along Barker Avenue.

 

The approval of a variance to the stated code does not relieve the property owner of any burden of maintenance, or repair, on the sanitary sewer services (including the length installed in public right of way and/or under paved public streets).

 

Action RequestUtility Department staff requests approval from the City Commission to grant the requested variance from 19-214B of the city code for Lot 1A of Maple Lawn Addition.
