RE:	March 24, 2009 Agenda Item – Easement Acquisition Payment 3100 Yellowstone and 2400 Atchison

Please include the following item on the City Commission Agenda for consideration at the March 24, 2009 meeting:

Authorize payment to Jeanette R. Denton and Norma M. Jantz for acquisition of permanent sanitary sewer easements in the amount of $17,759.00.

Project Description. The property owner contacted City Staff to inquire about the location, on the subject properties located at 3100 Yellowstone and 2400 Atchison, of existing sanitary sewer mains for which no recorded sanitary sewer easements could be found. City Staff researched the property and project records and were not able to identify the existence of sanitary sewer easements covering the existing City sanitary sewer lines.  Project records indicate the sanitary sewer lines were constructed in 1986.

The City contracted with LandPlan Engineering to survey the property and sanitary sewer lines (map), and with Keller & Associates to provide a fair market valuation of the required sanitary sewer easements.  The total takings were valued at $17,759.00. The property owners have accepted the appraised offer of compensation and executed the sanitary sewer easement documents.

Project Funding.  The payment will be funded from the 2009 Utility Department Operating Budget for Sanitary Sewer Extensions and Betterments.

Action Requested. Authorize payment to Jeanette R. Denton and Norma M. Jantz for permanent sanitary sewer easements in the amount of $17,759.00.
