Vacation of Right-of-Way; Vacation of Utility Easement

Please include the following item on the City Commission regular agenda for consideration at the March 10, 2009 meeting:

On March 10, 2009 the City Commission will open a public hearing to consider a request by owner Tenants to Homeowners, Inc., 2518 Ridge Court, Suite 209, Lawrence, KS  66046, for the vacation of 10’ of right-of-way of 12th Street and the vacation of a 10’ utility easement along the northern boundary of Lot 1, Block 1, Delaware Commons Addition II in the City of Lawrence. 

 

The existing 100’ right-of-way is excessive for a local road, and the utility easement serves no purpose.  In the original development plan sanitary sewer was to be constructed in the 10’ easement along the northern property boundary.  Under the revised development plan sanitary sewer will be constructed in the widened easement along the southern property boundary.  As such, the building envelopes should be located farther north which would only be possible with the proposed vacations due to setback requirements. 

 

All utilities, as well as city staff, have reviewed this request and have no objections.  All property owners within 200 feet have also been notified and no objections have been received.

 

Action Requested:     Hold public hearing and, pending discussion, approve order of vacation.
