Please include the following item on the City Commission regular agenda for consideration at the January 13, 2009 meeting:
On January 13, 2009 the City Commission will open a public hearing to consider a request by owner Evelyn J. Ryan, 744 N 8th Street, for the vacation of 30’ of right-of-way of Lake Street north of Lots 29 and 30 in Addition No. 9 of North Lawrence. The current owner has improvements (cellar and garage) within the platted right-of-way. The owner desires the vacation to facilitate the sale of the property. The entire area and right-of-way is within the 100 Year Flood Plain. The drainage ditch lies entirely in the north half of the right-of-way.
All utilities, as well as city staff, have reviewed this request and have no objections. All property owners within 200 feet have also been notified and no objections have been received.
Action Requested: Hold public hearing and, pending discussion, approve order of vacation.
