Calculations for SUP-07-04-08 Protest Petition |
Two petitions were filed in the City Clerk’s Office on September 5th and September 8th protesting the referenced special use permit request. The two petitions contain enough signatures of the record owners of property in the required notification area to constitute a valid protest petition. The property owner notification area includes the parcels lying within 200’ of the subject property.
The total area of the real property represented by the eighty-six (86) parcels captured within the required 200 feet notification distance from the property represented in the application is 15.728 acres. The protest petition was signed by owners of 35 parcels lying within the notification area. However, there were 18 parcels that could not be included in the petition calculations because the petition did not bear the signature of both record owners or it was signed by an individual whose name did not appear on the certified property ownership list from the county. The total area represented by the 17 parcels counted in the petition is 3.391 acres or approximately 21.56% of the real property within the 200 feet notification area. The petition is valid because it bears a higher percentage than the minimum 20% required by Code to constitute a valid protest petition.
The attached map illustrates the properties within the protest area whose owners are protesting this special use permit application.
