RE:	BKB Addition Replat; 811 Elm Street and 815 Elm Street (MS-03-04-08) Ordinance Variance Request

Please include the following item on the City Commission consent agenda for consideration at the August 5, 2008 meeting:

Approval of the request by Bruce and Kristen Barlow, property owners of 811 Elm Street and 815 Elm Street, for a variance from 19-214B of the code which states that a private sanitary sewer service line shall not be located in a City public right of way for greater than 15 feet. 

The existing sanitary sewer main is in the middle of Elm Street and the existing service lines to remain are more than 15 feet into the right of way.  The current property owners of 811 and 815 Elm Street have submitted an application to the planning department to join the two lots into one.  A building addition between the existing houses will result in one residential structure on the lot.  The minor subdivision replat identifies the proposed lot as BKB Addition.             

Action Request.  Utility Department staff requests approval from the City Commission to grant the requested variance from 19-214B of the city code for BKB Addition (currently 811 Elm Street and 815 Elm Street).
