RE:

Vacation of Fireside Drive from approximately 125’ south of Trail Road to Frontier Road

 

Please include the following item on the City Commission regular agenda for consideration at the July 15, 2008 meeting.

 

Background

The city received an application for the vacation of a portion of the right-of-way of Fireside Drive between Frontier Road and approximately 125’ south of Trail Road.  The purpose for seeking the vacation is to allow future improvements at Boardwalk Apartments to be more in compliance with the new development code and more sensitive to neighboring properties.

 

Status:

There are existing utilities within the right-of-way.  Easements for utilities as well as public and emergency service access will need to be retained. 

 

All property owners within 200’ of the proposed vacation were notified.  Several calls were received and most just wanted to know what was going to develop. One adjacent resident expressed concern about maintenance of the road, snow removal, access to his property, and if this street became private then the police could not enforce traffic violations, i.e. speeding.

 

At the date of the memo, a meeting is scheduled with the architect later this week to discuss the redevelopment of the site.

 

Actions Requested

Open public hearing and, pending public comment, approve order of vacation of Fireside Drive reserving easements for utilities (including stormwater) and public access, if appropriate.
