BEFORE THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS IN THE MATTER OF THE VACATION OF A RIGHT-OF-WAY IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS
NOW on this 15TH day of July 2008 the above entitled matter comes for hearing before the Governing Body of the City of Lawrence, Kansas.
THEREUPON, the Governing Body examines the matter, hears comments on the petition and being duly advised in the premises finds as follows, to-wit:
1. The Governing Body has jurisdiction on the subject matter pursuant to K.S.A. 12-502 et seq. as amended.
2. That notice of hearing of said petition and the affidavit of publication thereof are examined and found to have been duly made in strict conformity with the laws of the State of Kansas.
3. That no private rights will be injured or endangered by such vacation.
4. That no objection to said petition has been filed with the City Clerk at the time of or prior to the hearing.
5. That the City Clerk shall certify a copy of this Order to the Register of Deeds of Douglas County, Kansas, for recording as provided by K.S.A. 12-505, as amended.
IT IS THEREFORE, BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS, CONSIDERED AND ORDERED that the following described right-of-way
Beginning at the northwest corner of lot 1, block 5, of Pioneer Ridge in section 26, township 12, range 19 east of the sixth principal meridian, in the City of Lawrence, Douglas County, Kansas; thence N88˚13’08”E 219.82 feet; thence northeasterly along a curve to the left having a chord bearing of N43˚11’39”E and a radius of 130.00 feet for a distance of 204.33 feet; thence N01˚47’09”W 399.55 feet; thence S88˚12’36”W 60.03 feet; thence S01˚47’09”E 399.55 feet; thence southwesterly along a curve to the right having a chord bearing of S43˚10’31”W and a radius of 70.00 feet for a distance of 110.08 feet; thence S88˚13’08”W 219.85 feet; thence S01˚48’31”E 60.00 feet to the point of beginning, containing 1.07 acres more or less, Pioneer Ridge Subdivision, a subdivision in the City of Lawrence, Douglas County, Kansas,
is hereby vacated provided:
1. that the Governing Body reserves public easements for utilities, including stormwater, and public access.
