RE:	July 1, 2008 Agenda Item Public Hearing – Vacation of East 3’ of Indiana Street between 11^th & 12^th Street

Please include the following item on the City Commission regular agenda for consideration at the July 1, 2008 meeting:

On July 1, 2008 the City Commission will continue the public hearing on the vacation of the east 3’ of Indiana Street between 11^th and 12^th Street adjacent to Lot 1 of the Triple T Addition (the location of the Oread Inn project).

On May 20, 2008 the City Commission received a request from the development of the Oread Inn project to vacate the east 3’ of the Indiana Street right-of-way adjacent to their development. The need for this vacation arose from potential construction issues of the below ground parking structure (attached NSPJ correspondence dated 5/13/08.) The vacation process was initiated. On June 17, 2008 the City Commission opened the public hearing and, at the applicant’s request, deferred the hearing for two weeks.

Since the request, the development has made progress on the excavation and, due to soil conditions and construction techniques, may not need the entire 3’ of right-of-way. Attached is an update from the project architect (6/25/08 letter).

All utilities, as well as property owners within 200’, have been notified. The city has reviewed all the records and staff would recommend approval of this vacation.

Action Requested: Reopen the public hearing and, pending public comment, continue the hearing to July 15, 2008.
