RE:	June 17, 2008 Agenda Item Public Hearing – Vacation of East 3’ of Indiana Street between 11^th & 12^th Street

Please include the following item on the City Commission regular agenda for consideration at the June 17, 2008 meeting:

On June 17, 2008 the City Commission will open/hold a public hearing on the vacation of the east 3’ of Indiana Street between 11^th and 12^th Street adjacent to Lot 1 of the Triple T Addition (the location of the Oread Inn project).

On May 20, 2008 the City Commission received a request from the development of the Oread Inn project to vacate the east 3’ of the Indiana Street right-of-way adjacent to their development. The need for this vacation arose from potential construction issues of the below ground parking structure (attached NSPJ correspondence dated 5/13/08.) The vacation process was initiated.

All utilities, as well as property owners within 200’, have been notified. The city has reviewed all the records and staff would recommend approval of this vacation. Prior to the execution of the order of vacation, the applicant and the City will agree on the appropriate compensation for the right of way vacation.

Action Requested: Hold public hearing and, pending public comment, continue the hearing to a future date or approve the vacation.
