Lot 1 and Lot 2 of Paley’s Subdivision – 740 Ash Street (MS-12-19-07), Ordinance Variance Request

 

Please include the following item on the City Commission consent agenda for consideration at the March 4, 2008 meeting:

Approval of the request by George F. Paley, property owner of 740 Ash Street for a variance from 19-214B of the code which states that a private sanitary sewer service line shall not be located in a City public right of way for greater than 15 feet. 

The current property owner has submitted an application to the planning department for a lot split at 740 Ash Street into Lot 1 and Lot 2.  Lot 1 has an existing building; Lot 2 is undeveloped.  Since the existing sanitary sewer main is in the middle of 740 Ash Street, the existing service line for Lot 1 and the proposed service line for Lot 2 do not meet the current city code 19-214B stating that private service lines shall not be more than 15 feet into the right of way.

Action Request.  Utility Department staff requests approval from the City Commission to grant the requested variance from 19-214B of the code for the Lots 1 and 2 of Paley’s Subdivision.
