Please include the following item on the consent agenda for the February 13, 2007 City Commission meeting.

 

Enter into a License Agreement with Van Go Mobile Arts, Inc. to allow for the installation and maintenance of a drop-off lane and solar-powered bollards within the right-of-way at 715 New Jersey Street.

 

Project Description:  Given the irregularity of the exiting right-of-way, the mixed use of the surrounding properties, and the unique nature of the specified use for this site, Van Go requests permission to install a drop off lane within the New Jersey Street right-of-way adjacent to their building.  For both aesthetic and safety reasons, Van Go additionally requests permission to install lighted bollards within the sidewalk area of the New Jersey Street right-of-way.

 

Project History:  In September, 2006, staff met with the project proponents to discuss development requirements for the Van Go site and was asked to consider a variety of issues including both the drop-off lane the lighted bollards.  Staff met internally to discuss the site-specific issues and concluded that both the drop-off lane and the lighted bollards could be permissible provided that the property owners enter into a Right-of-Way Agreement for both the installation and maintenance of the requested improvements.  An internal staff memo summarizing those discussions was prepared (See attached memo). 

Project Funding:  All installation and maintenance costs for the improvements will be funded by the property owner.

  

Action Request:  Authorize the City Manager to enter into a License Agreement with Van Go Mobile Arts, Inc. to allow for the installation and maintenance of a drop-off lane and solar-powered bollards within the right-of-way at 715 New Jersey Street.
