AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, AMENDING ORDINANCE NO. 6989 TO REVISE CONDITIONS PLACED ON THE PCD-[STONERIDGE PLAZA] (PLANNED COMMERCIAL) DISTRICT, AMENDING THE CITY’S “OFFICIAL ZONING DISTRICT MAP,” INCORPORATED BY REFERENCE INTO THE CITY CODE AT CHAPTER 20, ARTICLE 1, SECTION 20-108 OF THE CODE OF THE CITY OF LAWRENCE, KANSAS, 2018 EDITION, AND AMENDMENTS THERETO, TO REFLECT THOSE AMENDED CONDITIONS, AND REPEALING EXISTING ORDINANCE NO. 6989.

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION 1: City of Lawrence, Kan., Ord. No. 6989 (Feb. 27, 1998), is hereby amended to read as follows:

 

            WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission recommended that the zoning classification for the following described tract of land within the City of Lawrence, Douglas County, Kansas, to-wit:

 

Lot 2, Alvamar West No. 9, a Subdivision in the City of Lawrence, Douglas County, Kansas,

 

be changed from RO-1 (Residence-Office District) to PCD-2 (Planned Commercial District) subject to certain conditions; and

 

            WHEREAS, after due and lawful notice the zoning recommendation came on for hearing before the Governing Body of the City of Lawrence, Douglas County, Kansas, and after due consideration and deliberation, the recommended zoning change was approved subject to the conditions as listed below.

 

            NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

            SECTION I. The above-stated recitals are by reference incorporated herein, and shall be as effective as if repeated verbatim.

 

            SECTION II. That the zoning district classification for the following described tract of land situated located in the City of Lawrence, Douglas County, Kansas, to-wit:

 

Lot 2, Alvamar West No. 9, a Subdivision in the City of Lawrence, Douglas County, Kansas,

 

be and the same is hereby changed from that of RO-1 (Residence-Office District) to PCD-2 (Planned Commercial District) (PCD-[Stoneridge Plaza](Planned Commercial) District), as such district is defined and prescribed in Chapter 20 of the “Code of the City of Lawrence, Kansas, 1997,” and amendments thereto, subject to the following conditions:

 

(1)        Restriction of uses to PCD-1 uses plus the addition of Use Group 15, Athletic Club; but excluding a pawn shop and Use Groups 13 and 14; and

 

(2)        Limiting square footage to 12,700 sq. ft. of commercial/retail uses, with the balance of the project to be office use.         

 

(a)        The PCD-[Stoneridge Plaza] (Planned Commercial) District shall be limited to the following uses:

 

(i)         Multi-Dwelling Structures;

 

(ii)        Non-Ground Floor Dwellings;

 

(iii)       Use Groups 7, 8, 9, 9A, 11, and 12 from the 1966 Zoning Ordinance, as amended, excluding Pawnshops; and

 

(iv)       Athletic Club.

 

(b)        The maximum area of commercial/retail use permitted in the district is limited to 12,700 square feet, with the balance of the project to be residential and office uses.

 

            SECTION III. That the Zoning Districts Map incorporated by reference in and by Chapter 20, Article 5, Section 501, of the “Code of the City of Lawrence, Kansas, 1997,” be and the same is hereby amended by showing and reflecting thereon the new zoning district classification for the aforesaid tract, as set forth in Section II of this ordinance.

 

            SECTION IV. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.

 

SECTION 2. The “Official Zoning District Map,” which is adopted and incorporated into the City Code by reference at City of Lawrence, Kan., Code § 20-108 (Jan. 1, 2018), is hereby amended by showing and reflecting thereon the new conditions for the subject property as described in more detail in Section 1, supra.

 

SECTION 3. City of Lawrence, Kan., Ord. No. 6989 (Feb. 27, 1998), is hereby repealed, it being the intent of the Governing Body that the provisions of this ordinance supersede it in its entirety.

 

SECTION 4. If any section, sentence, clause, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance. 

 

SECTION 5. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
