Recommendations/Options/Action Requested:

 

Approve a Special Use Permit, SUP-18-00625, and adopt on first reading, Ordinance No. 9659. The special use permit and ordinance would permit a non-owner occupied Short-Term Rental   at 630 Indiana Street. The rental use is limited to no more than two guestrooms and the occupancy is limited to no more than three unrelated adults. Submitted by Charles and Leda Sedlock, property owners of record.  

 

Executive Summary:

Short-Term Rental uses were recently added to the Land Development Code as uses permitted in specific zoning districts. Short-Term Rental uses are permitted with licensing when they are accessory to owner occupied residences, but require approval of a special use permit when they occur in non-owner occupied residences. Standard conditions for the use include a requirement that the property remain residential in character and that the use must be licensed with the City.

 

The subject property has never had any off-street parking spaces and one parking space is required for each guest room. A maximum of two guest rooms is permitted for the subject property. The subject property was built prior to the City’s first zoning code in 1927; therefore, its parking status is an existing non-conformity and an allowance of two parking spaces is granted. Two spaces were granted as that is the required off-street parking amount for the Detached-Dwelling use. Section 20-901(2)(I) and Section 20-901(2)(II) of the Land Development Code note,

 

Unless otherwise expressly stated, the parking and loading standards of this article apply whenever an existing Building or use is enlarged or expanded to include additional dwelling units, floor area, seating capacity, employees or other units of measure used for establishing off-street parking and loading requirements.

 

And,

 

In the case of enlargements or expansions of Buildings or uses triggering requirements for additional parking or loading, additional off-street parking and loading spaces are required only to serve the enlarged or expanded area or use, not the entire existing Building or use. There is no requirement to address lawfully created non-conforming existing parking or loading deficits.

 

All properties containing a Short-Term Rental use shall comply with the occupancy limits established in Section 20-601(d). The subject property is zoned RS5 (Single-Residential Dwelling) District, which permits a maximum number of 3 unrelated occupants per dwelling unit.
