Conduct the public hearing regarding the fire-damaged structure (single-family detached house) located at 1116 New Jersey Street. Staff recommends that the City Commission adopt Resolution No. 7284, declaring the structure as unsafe and dangerous structure, and directing staff to demolish and remove the structure if the owner fails to substantially repair or demolish and remove the structure by May 19, 2019 (permit expiration). All incurred costs and expenses associated with the demolition would be assessed against the property. |

Executive Summary: |
On February 5, 2019, the City Commission adopted Resolution No. 7278, which set a public hearing date of March 19, 2019 to hear testimony, at which time any person having any interest in the property may appear and show cause why the structure should not be condemned as an unsafe and dangerous structure and ordered repaired or demolished.
Staff provided a memorandum dated February 5, 2019 that outlined a summary of events that have transpired after the house was damaged by fire on June 3, 2018.
Update since the adoption of Resolution No. 7278
The structure’s condition remains unchanged with the exception of a new front door and an attic window being installed on the west side of the house.
Staff has had no further contact with Mr. Mellenbruch but has spoken to his family on a few occasions in which staff was advised the family is in the process of securing a new contractor to continue with the issued building permit which remains active.
On March 6, 2019, staff spoke with Alan Rector with A-Team Home Improvement Inc. Mr. Rector advised he was in discussion with family members of Mr. Mellenbruch to become the framing contractor or the general contractor for the project and would keep staff updated on his role.
Staff recommends adopting Resolution No. 7284 in order to maintain forward movement in bringing the property into compliance.

Fiscal Impact (Amount/Source): |
The fiscal impact to the City would be the cost incurred for the City to demolish and remove the structures, which would be determined through a bid process. A lien would then be assessed against the property in accordance with K.S.A. 40-3901 et. seq. |
