Approve a Special Use Permit, SUP-18-00565, and adopt on first reading, Ordinance No. 9644. The special use permit and ordinance would permit a non-owner occupied Short-Term Rental at 888 New Hampshire Street, units #208, #209 and #216. The rental use is limited to no more than the four guestrooms in the specified units and the occupancy is limited to no more than four unrelated adults per dwelling unit. Submitted by First Management, Inc. on behalf of 100 East Ninth Street, LLC, property owner of record. |

Executive Summary: |
Short-Term Rental uses were recently added to the Land Development Code as uses permitted in specific zoning districts. Short-Term Rental uses are permitted with licensing when they are accessory to owner occupied residences, but require approval of a special use permit when they occur in non-owner occupied residences. Standard conditions for the use include a requirement that the property remain residential in character and that the use must be licensed with the City.
This property is currently being used as a multi-dwelling building that was approved under site plan #SP-14-00395. The units specified for Short-Term Rental use are as follows: Unit #208 = 2 guestrooms Unit #209 = 1 guestroom Unit #216 = 1 guestroom
Other units within the building will remain long-term rental units.
The subject property does not require off-street parking spaces per Section 20-901(f) of the Land Development Code that provides a parking exemption in the CD district. The short-term rental use is not increasing the parking demand and the subject property conforms to the requirements for parking in the district.
All properties containing a Short-Term Rental use shall comply with the occupancy limits established in Section 20-601(d). The subject property is zoned CD-UC (Downtown Commercial) District, which permits a maximum number of 4 unrelated occupants per dwelling unit for all unit types other than single-detached dwellings. |
